Uniform Disciplinary Act Changes for Those Professionals Under Supervision or Floating

One notable change is the new disclosure requirements regarding provider sexual misconduct. Effective October 1, 2019, health care providers subject to the UDA must inform patients, if they have been sanctioned for unprofessional conduct involving sexual misconduct. This requirement applies to sanctions imposed on or after this date.

Specifically, the disclosure “most only be provided to a patient at or prior to the patient’s first visit with the license holder following entry of the order or stipulation.”

However, what if you are on assignment as a “float” staff or a patient is not scheduling a visit with you specifically? In particular for any health care provider who is working under the supervision or licensure of another, where the patients are not making appointments directly with the support staff?

There is room for argument, and it may not be as daunting of a requirement for those who are under a term of probation or oversight for sexual misconduct of another practitioner.
