EXPECT A FAIR LICENSURE HEARING? GUESS AGAIN.
The State is said to use RCW 34.12.050 to intimidate judges. A recent interview with a former judge at the Office of Administrative Hearings revealed that regulatory Departments use a statute allowing any party to file a motion of prejudice to request assignment of a different judge. The State is alleged to have used the statute to intimidate judges at OAH not to rule against them. It was alleged that Departments will move to recuse any judge who rules against them with any regularity. As the Departments are always one party in any hearing matter, they can effectively put a judge out of a job. Judges know this, purportedly avoid ruling against the Departments except upon rare occasion. Now, there is justice for you.
