Don’t Make The Usual Mistakes When Dealing With Your Regulatory Agency
People commonly make the same mistake when dealing with their licensing body, whether it be the Department of Licensing, Department of Health, or Department of Financial Institutions. People believe that, if they only explain, the investigation will go away. That belief, while understandable, contains a fundamental misapprehension about the goal of the agency overseeing your profession. Those agencies do not see themselves as being professional associations designed to guide and aide those who work under their auspices. Rather, licensing bodies consider themselves as regulatory agencies, the police of your profession. When the Department investigates you, they are seeking to develop a case against you. What you say to them can and will be used against you. Thus, your explanations will never provide an excuse. They are only interested in what you say in order to build a case against you. Do not communicate with the Department without consulting a qualified attorney.
